Service Terms for Ness PC Repairs

These Terms and Conditions govern the repair and IT services provided by Ness PC Repairs. By using our services, you agree to these terms. Please read them carefully before booking any work.

We provide computer repair, IT support, and related services to customers in Inverness and the surrounding Highlands. These terms apply to all services we provide.

2. Acceptance of Terms

By requesting our services, leaving equipment with us, or accepting a quote, you agree to be bound by these Terms and Conditions. If you don't agree with these terms, please don't use our services.

When you ask us to fix your computer, you're agreeing to these rules. We've written them in clear language, but if anything's unclear, just ask before we start work!

3. Services We Provide

We offer the following services:

  • Computer and laptop repairs (hardware and software)
  • Virus and malware removal
  • Data recovery services
  • Hardware upgrades (SSD, RAM, graphics cards, etc.)
  • Operating system installation and configuration
  • Network and broadband setup
  • IT support and troubleshooting
  • Custom PC building
  • Remote support services
  • Other related computer services as agreed

We reserve the right to refuse service if we believe the work is beyond our capability, too risky, illegal, or if we have concerns about the customer.

4. Quotations and Pricing

4.1 Diagnostic Fee

We charge a diagnostic fee (typically £20) to assess your device and identify the problem. This fee is waived if you proceed with the repair. If you choose not to proceed, the diagnostic fee is payable.

4.2 Fixed-Price Quotes

After diagnosis, we'll provide a fixed-price quote for the repair including parts and labour. This price is guaranteed - we won't increase it unless you request additional work or we discover new issues not visible during diagnosis.

4.3 Additional Work

If we discover additional problems during repair, we'll contact you for approval before proceeding with any extra work. You won't be charged for work you haven't authorized.

4.4 Quote Validity

Quotes are valid for 30 days. After this, prices may change due to parts cost fluctuations. If you want to proceed after 30 days, please contact us for an updated quote.

5. Payment Terms

💳 Payment Methods

We accept cash, card payments, and bank transfers. Payment is due when you collect your repaired device.

⏰ Payment Timing

Full payment must be made before your device is returned to you. We cannot release equipment until payment is received.

📄 Invoices

A receipt/invoice will be provided upon payment. Keep this for warranty purposes and your records.

⚠️ Late Payment

If you don't collect and pay for your device within 30 days of notification, we reserve the right to charge storage fees or dispose of the equipment (see section 11).

6. Repair Timeframes

We aim to complete repairs as quickly as possible, but timeframes depend on several factors:

  • Parts availability (we need to order some components)
  • Complexity of the repair
  • Our current workload
  • Unforeseen technical difficulties

Estimated timeframes are guidelines only, not guarantees. We'll keep you updated on progress, but delays can occur due to parts shortages, courier delays, or unexpected complications. We're not liable for any losses caused by repair delays.

⚠️ Important:

If you need your device urgently for work, travel, or other important reasons, please tell us upfront. We'll do our best to prioritize, but we cannot guarantee completion by a specific date. Consider having backup equipment available for essential tasks.

7. Data Backup and Loss

⚠️ CRITICAL: READ THIS SECTION CAREFULLY

7.1 Your Responsibility

YOU are responsible for backing up your data before bringing your device to us. We strongly recommend having at least two backups of any important files, photos, documents, or other data.

We are NOT responsible for any data loss that occurs during repair, even if we take every precaution.

7.2 Data Loss Can Occur

Data loss can happen during repairs due to:

  • Failed hard drives or SSDs
  • Corruption during Windows reinstallation
  • Hardware failures
  • Required formatting or partition changes
  • Unforeseen technical issues

7.3 Data Recovery Services

If you haven't backed up your data and need it preserved, we offer data backup services before repair work begins (additional charge). This is optional but highly recommended.

7.4 No Liability for Data

By leaving your device with us, you acknowledge that we are NOT liable for any data loss, corruption, or deletion. This applies even if data loss occurs due to our error. We cannot recover lost photos, documents, or files if they weren't backed up.

8. Warranty and Guarantees

8.1 Our Warranty

We provide a 3-month warranty on all repairs and replacement parts (unless otherwise stated). This covers:

  • Defective replacement parts
  • Failure directly related to the repair we performed
  • Workmanship issues with our installation

8.2 What's NOT Covered

Our warranty does NOT cover:

  • Damage caused after you collected the device (drops, liquid spills, etc.)
  • Issues unrelated to the original repair
  • Normal wear and tear
  • Damage caused by viruses or malware
  • Software issues not related to the repair
  • Parts that were already faulty but not part of the repair
  • Modifications or repairs done by others after our work

8.3 Manufacturer Warranties

New parts come with manufacturer warranties (typically 1-3 years depending on the component). We'll provide warranty details with your receipt.

8.4 Claiming Warranty

To claim under warranty, bring the device back with your original receipt. We'll assess the issue and repair/replace free of charge if it's covered. If it's not warranty-related, we'll provide a quote for the new work.

9. Limitation of Liability

We take every care with your equipment, but we must limit our liability as follows:

9.1 Maximum Liability

Our maximum liability for any claim is limited to the amount you paid us for the service that caused the issue. We are not liable for consequential losses, lost business, lost data, or lost profits.

9.2 Pre-Existing Faults

We're not responsible for pre-existing faults, wear, or damage that wasn't part of the repair we performed. We'll inform you of any additional issues we discover, but we're not liable for them.

9.3 Data and Software

We are NOT liable for loss of data, software, settings, or configurations. See section 7 regarding data backup.

9.4 Your Statutory Rights

Nothing in these terms affects your statutory rights as a consumer under UK law (Consumer Rights Act 2015). Services must be performed with reasonable care and skill.

10. Customer Responsibilities

As a customer, you agree to:

✅ Backup Your Data

Take responsibility for backing up all important data before leaving equipment with us.

✅ Remove Valuable Data

Remove or secure any confidential, sensitive, or valuable data. We may need to access your device during testing.

✅ Provide Accurate Information

Give us accurate information about the problem, any passwords we need, and your contact details.

✅ Collect Promptly

Collect your device promptly after notification. We have limited storage space.

✅ Pay on Collection

Arrange payment when collecting your repaired device.

✅ Own the Equipment

Confirm that you own the device or have permission from the owner to have it repaired.

✅ Legal Use Only

Not request anything illegal or unethical (software piracy, password cracking, etc.).

11. Uncollected Items

11.1 Collection Period

Once your repair is complete, we'll contact you to arrange collection. You should collect your device within 14 days of notification.

11.2 Storage Fees

After 30 days, we may charge a storage fee of £5 per week. After 90 days, we reserve the right to dispose of uncollected items to recover costs.

11.3 Abandoned Equipment

If we cannot contact you after 90 days despite reasonable attempts (phone, email, registered letter), equipment will be considered abandoned and disposed of. We are not liable for abandoned items.

12. Cancellations and Refunds

Before Work Starts

You can cancel at any point before we start work. Only the diagnostic fee (if applicable) is payable. No other charges apply.

After Work Starts

If work has begun (parts ordered, labour started), you'll be charged for work completed and any non-returnable parts. We'll calculate this fairly.

Refunds

If we cannot fix the problem after reasonable attempts, we'll refund your payment (minus diagnostic fees and any non-returnable parts already purchased).

Consumer Rights

Under the Consumer Rights Act 2015, services must be performed with reasonable care and skill. If we fail to meet this standard, you have legal rights to remedies, repeat performance, or price reduction.

13. Privacy and Data Protection

We handle your personal information in accordance with UK GDPR and our Privacy Policy. We only collect information necessary to provide our services and keep it secure. You have full rights over your personal data.

14. Security and Confidentiality

We take reasonable precautions to keep your equipment secure while in our care:

  • Equipment stored in locked premises
  • Limited access to customer devices
  • We don't deliberately browse your files
  • Passwords deleted after testing complete

However, we may need to access your device during diagnosis and testing. If you have highly sensitive data, please remove it before leaving equipment with us.

15. No Illegal Content or Activities

We will not service equipment that contains or is used for illegal content or activities. This includes but is not limited to: pirated software, illegal content, hacking tools, or stolen property. If we discover illegal content, we reserve the right to refuse service and may report to authorities if required by law.

16. Parts and Components

16.1 Quality Parts

We use quality replacement parts from reputable suppliers. We don't use the cheapest parts available - we prioritize reliability and longevity.

16.2 New vs Refurbished

We typically use new parts unless otherwise agreed. If a refurbished part makes sense for cost reasons, we'll discuss this with you first.

16.3 Old Parts

Replaced parts (especially hard drives containing your data) will be returned to you unless you specifically request disposal. We can securely wipe drives before disposal if requested.

17. Intellectual Property

We will not install pirated software, crack passwords without proper authorization, or engage in any activity that violates intellectual property rights. All software installed must be properly licensed.

18. Force Majeure

We're not liable for delays or failures caused by circumstances beyond our reasonable control, including: natural disasters, pandemics, supplier failures, courier delays, power outages, internet outages, or government restrictions.

19. Disputes and Resolution

If you're unhappy with our service:

Step 1: Contact Us

Call or email us to explain the problem. Most issues can be resolved through friendly conversation.

Step 2: Formal Complaint

If not resolved, send a formal written complaint. We'll investigate and respond within 14 days.

Step 3: Alternative Dispute Resolution

If still unresolved, you can use the European Consumer Centre or Trading Standards for mediation.

20. Governing Law

These Terms and Conditions are governed by the laws of Scotland and England & Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of Scotland.

21. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be posted on our website with the "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.

22. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
